These Terms of Service ("Terms") govern your use of the QuickByte web application and related services (the "Service") provided by TallNBurly ("we", "us", "our"). By creating an account or using the Service, you agree to be bound by these Terms.
1. The Service
QuickByte helps users discover budget-friendly recipes based on their ZIP code and the grocery stores they shop at. The Service is provided on a subscription basis and may include free features. We may add, change, or remove features at any time.
2. Eligibility & accounts
You must be of legal age to form a binding contract in your jurisdiction. You agree to provide accurate information when creating your account and to keep it up to date. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
3. Acceptable use
You agree not to misuse the Service. In particular, you must not:
- Use the Service for any unlawful, fraudulent, or deceptive purpose;
- Send spam, malware, or otherwise harmful content;
- Infringe the intellectual property or privacy rights of any person;
- Probe, scan, or test the vulnerability of the Service, or breach security or authentication measures;
- Scrape, harvest, or systematically extract data from the Service;
- Reverse engineer, decompile, or attempt to derive the source code of the Service except where permitted by law;
- Resell or redistribute the Service or circumvent any technical limits.
4. Intellectual property
The Service, including all software, content, recipes, branding, and documentation, is owned by TallNBurly or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal use in accordance with your subscription plan.
5. User content
You retain ownership of any content you submit to the Service. You grant us a worldwide, non-exclusive license to host, store, and process that content solely as needed to provide the Service to you.
6. Payments, subscriptions and Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, cancellations, renewals, and refund mechanics are governed by the Paddle Buyer Terms. Subscriptions renew automatically each billing period until cancelled.
7. Cancellation and refunds
You may cancel your subscription at any time from your account settings or by contacting Paddle. After cancellation you retain access until the end of your current billing period. Refunds are handled under our Refund Policy and the Paddle Buyer Terms.
8. Suspension and termination
We may suspend or terminate your access to the Service if you materially breach these Terms, if payment fails, if we identify a security or fraud risk, or for repeated or serious policy violations. On termination, your right to use the Service ends and we may delete your account data after a reasonable retention period.
9. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or free of harmful components. Recipes, macros, and prices shown in the Service are estimates and may not be accurate for your specific store, region, or dietary needs — always verify ingredients and nutrition information yourself, especially if you have allergies or medical conditions.
10. Limitation of liability
To the fullest extent permitted by law, our aggregate liability arising out of or relating to these Terms or the Service is limited to the amounts you paid us for the Service in the twelve (12) months immediately preceding the event giving rise to the claim. We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses. Nothing in these Terms excludes liability that cannot lawfully be excluded.
11. Indemnity
You agree to indemnify and hold us harmless from any claim, loss, or expense arising out of your content, your misuse of the Service, or your breach of these Terms.
12. Changes to these Terms
We may update these Terms from time to time. We will notify you of material changes by posting an updated version with a new "Last updated" date. Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
13. Governing law
These Terms are governed by the laws of the jurisdiction in which TallNBurly is established, without regard to its conflict-of-laws principles. The courts of that jurisdiction have exclusive jurisdiction over any disputes, except where mandatory consumer-protection law of your residence provides otherwise.
